Terms of Use
1. About these terms
These terms are an agreement between you and Rozanne Scott, trading as Checky (Roodepoort, Gauteng 1724, South Africa; checkdieapp@gmail.com). By creating an account or using Checky, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Checky.
2. Who may use Checky
- You must be at least 18 years old and able to enter into a binding agreement.
- You may add information about children only if you are their parent, legal guardian or another person entitled to act for them.
- One account is for one person. Keep your password private. You are responsible for what happens in your account.
3. How Checky works
- Personal space: visible only to you.
- Households: a household is shared by up to two parents. Everything in a household's shared space can be seen by both parents in it. You can belong to up to three separate households, and they never share information with each other.
- Approvals: some changes (for example set dates, holiday arrangements and money records) only take effect once the other parent approves them. Checky records requests, approvals and disagreements, but it does not decide disputes.
- Invites: only invite someone to a household if they are the other parent or guardian of the children in it.
4. Your content
- You own the information, documents and photos you add ("your content"). You give Checky permission to store, show and process your content only so that we can run Checky for you and the people you share a household with.
- Make sure your content is accurate, and that you are allowed to share it, including information about other people.
- Do not use Checky to harass, threaten, insult or deceive anyone, to upload unlawful material, or to try to get into accounts or households that aren't yours. Checky's friendly-note check is there to help keep communication respectful.
- We may remove content or suspend an account that breaks these terms or the law, and we will tell you why unless the law prevents us.
5. Not professional advice, and not a court record
Checky is an organising tool. It does not give legal, medical, financial or psychological advice. Information in Checky, including the custody calendar, does not replace or change a court order, parenting plan or agreement. If Checky and a court order differ, the court order applies. Exports and screenshots from Checky are not certified court records. Always check important information, such as medication doses and due dates, with the right professional.
6. Prices and subscriptions
- Checky's subscription is R80 per month or R800 per year, per person. If you share a household, each parent pays for their own account. The price and what it includes are shown before you pay. We may offer a free trial, and its length is shown when you start it.
- Subscriptions renew automatically until cancelled. You can cancel at any time. Cancelling stops the next renewal, and you keep access until the end of the period you paid for.
- Under the Electronic Communications and Transactions Act, you may cancel a new subscription within 7 days of buying it without giving a reason, and we will refund your payment within 30 days.
- If you subscribe through Google Play or another app store, that store processes the payment and its cancellation and refund rules also apply.
- We may change prices. We will give you at least 30 days' notice before a new price applies to your subscription, and you may cancel before then.
7. Availability and changes
We work hard to keep Checky available and your information safe, but Checky may sometimes be unavailable for maintenance or reasons outside our control. We may improve, change or stop features. If we ever close Checky, we will give you reasonable notice and a chance to download your information.
8. Ending your account
You can delete your account at any time in the app (Menu → Household setup → Delete my account) or by emailing us. See Delete your account for what is deleted and what stays with the other parent. We may close an account that seriously or repeatedly breaks these terms.
9. Responsibility
To the extent the law allows, Checky is not responsible for losses caused by information you or the other parent added, by decisions made based on that information, by the other parent's use of a shared household, or by events outside our reasonable control. Where we are responsible, our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under the Consumer Protection Act or other law that cannot be limited.
10. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change is significant, we will tell you in the app or by email before it applies. If you keep using Checky after that, the new terms apply.
11. Law and disputes
These terms are governed by the law of the Republic of South Africa. If you have a complaint, please contact us first at checkdieapp@gmail.com so we can try to sort it out.
